These Terms of Use (“Terms”) govern your access to and use of atlasmedia-ma.com (the “Site”), operated by Atlas Media (“Atlas Media,” “we,” or “us”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. About these Terms and our services

These Terms cover your use of the Site only. Marketing, SEO, advertising, and AI services we provide to clients are governed by a separate written agreement. Browsing the Site, submitting our intake form, or emailing us does not create a client relationship, and we have no duty of confidentiality until we have agreed in writing to work together. Please don’t send confidential or sensitive information before then.

2. Using the Site

You agree to use the Site lawfully. You will not:

  • interfere with or disrupt the Site or its security;
  • attempt to gain unauthorized access to the Site, its servers, or related systems;
  • scrape or copy the Site at scale or by automated means, other than ordinary search-engine indexing;
  • transmit malware or unlawful, harmful, or misleading content; or
  • misrepresent your identity or submit false information through our intake form.

3. Intellectual property

The Site and its content — including text, design, graphics, logos, images, and code — are owned by or licensed to Atlas Media and protected by intellectual-property laws. We grant you a limited, non-exclusive, revocable license to view the Site for your own informational use. You may not copy, modify, distribute, or create derivative works from Site content without our written permission, except as the law allows.

Names and logos of third-party platforms and products that appear on the Site — such as Meta, Facebook, Instagram, Google, YouTube, and Google Ads — are trademarks of their respective owners. They are shown only to identify the platforms we work with, and their appearance does not imply sponsorship, endorsement, or affiliation.

4. No professional advice; no guarantee of results

Content on the Site is general information about our services. It is not legal, financial, or other professional advice. Marketing, search, advertising, and AI results depend on many factors outside our control and vary from business to business. Descriptions of our services and approach on the Site are not guarantees of any particular outcome.

5. Third-party links and services

The Site links to services we don’t control, including the Google-hosted intake form. We are not responsible for the content, terms, or privacy practices of third parties, and you use them at your own risk. See our Privacy Policy for how we handle information you give us.

6. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ATLAS MEDIA AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions don’t allow certain exclusions or limits, so parts of this section may not apply to you, and nothing in these Terms limits liability that cannot be limited by law. These limits apply to use of the Site only; liability for services is governed by the applicable client agreement.

8. Changes

We may change the Site or these Terms at any time. We will post the updated Terms with a new “Last updated” date. If you keep using the Site after changes are posted, you accept the updated Terms.

9. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. You and Atlas Media agree that any dispute relating to the Site will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.

10. General

These Terms, together with our Privacy Policy, are the entire agreement between you and Atlas Media about the Site. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may.
